HAGAI & CO has experience in legal industry for both Litigation (Dispute Settlement Through the Court) and Non-Litigation (Dispute Settlement Outside the Court), especially in Specific Civil Law about Bankruptcy, Suspension of Payment (PKPU), and Agrarian Law and Property Law also other legal fields by performing the following:
LITIGATION (Dispute Settlement Through the Court)
To assist and represent client in regard to the a quo case by attending the District Court (Court of First Instance), High Court (Appeal Court) until Supreme Court (Cassation and Judicial Review) to assist and represent Client in regard to the case a quo;
To take legal action for every person, related parties, Corporate or Company, and Legal Entity in regard to the case that Hagai & Co handles;
Draft, sign also attend all court proceedings in District Court, High Court, Supreme Court by roviding evidences, bring witnesses, accept and/or refuse witnesses, accept and/or refuse reconciliation, draft answer to the opponent, draft conclusion letter and/or receive/ask for Verdict/Decree/Final Judgement;
Negotiate and perform reconciliation by agreement from legal opinion/suggestion, vote in mediation process, and also sign the reconciliation agreement;
Appear to the Placeman and/or authorized agencies/institutes, defend the rights and public interest, including draft, sign, and submit letters, accept and/or refuse statement, information and explanation, also do all the necessary legal action for and on behalf of Authorizer;
To appear in District Court, High Court and Supreme Court also other Judiciary, Committee, Bailiff, Clerk of a Court and/or Judges or Supervising Judge of District Court, Auction Committee, Civil and State Officials that related to the case and also defend and maintain Client’s interest. Submit and/or Refuse evidences, draft, sign, and submit application or other related letters, receive correspondences, give statements, accept and/or refuse meeting result, do and/or refuse a payment, draft and sign receipts, hold and do necessary things without exception to maintain and defend Client’s rights and interest.
Checking the documents, hold a meeting, mediation, negotiate, sign the meeting minutes, draft agreements, and also perform all necessary and beneficial action for Client’s legal interest which doesn’t contradict and break the laws and regulation in Republic in Indonesia and handover part or all of the power to other person (Substitution Right) with the right to withdraw the handover of power that have been given
NON-LITIGATION (Dispute Settlement Outside the Court)
Provide a Legal Opinion, Legal Review, Legal Due Diligence and Audit Legal for Client’s interest;
Hold a meetings and negotiation between Hagai & Co and Team or Client’s representative to provide Legal or other Adviee regarding things that have been done indispute settlement according to the time and place agreed between Hagai & Co as attorney with Client;
Gather required and/or necessary data's, information and supporting document's as evidence to take legal action in regard to the case a quo that Hagai & Co will handle;
Do correspondence with related parties according to the case a quo;
Searching for persons whom related to the legal case with refuse mediation proposed by the opponent and also provide the best solution in regard to the settlement of case a quo.
Bankruptcy and Suspension of Payment (PKPU)
Submit application of Bankruptcy or PKPU. Bankruptcy/PKPU is a legal action to help creditors collect debtor's debts through Court’s mechanism with a fast court proceeding which is only 20 days in according to the Regulation of Bankruptcy/PKPU;
Choose and appoint Management for debt restructuring;
Assist and strive for Client’s interest for its right in the reconciliation application, debt verification, and voting in reconciliation proposal.
Agrarian Law (Agraria/Property)
Assist and strive for Client’s interest regarding land disputes;
Legal process regarding land such as land rights liberation, location permit application/SK BPN regarding location permit, land certificates, mortgage application also extension of HGB, HGU, Right of Use, and others;
Proceed end to end legal process until right issuance of property.
General and Specific Civil Law and Business Law
Provide Legal Opinion for company’s legal action also do Legal Due Diligence for company’s condition;
Submit civil lawsuit of Client’s disputes in civil fields;
Take legal action (verzet, appeal, cassation and judicial review) and submit execution; Submit application of determination such as adoption and others;
Represent legal interest of Authorizer in all of Judiciary in Indonesia;
Establishment of Civil Partnership Legal Entity (Maatshap), Limited Partnership (CV), Firm Association, Limited Liability Company (PT), Foundation, Coop and other Legal Entities;
Company’s legal action such as Merger, Consolidation, and Acquisition;
Submit trademark rights, patents, and copyrights, licensing and also other legal aspects and dispute precaution also legal preventive, Intellectual Property Rights (HAKI)
Family Law (Except Divorcement)
Family Law (in accordance with Burgelik Wet Boek ("BW" or Civil Code) and Islamic Code;
Provide Legal Consultation regarding guardianship dispute of child and marital property distribution (gono gini), inheritance distribution, grants and wills;
Submit determination of inheritance application and child adoption;
Submit child custody application;
Submit common property application (gono gini);
Take legal action (verzet, appeal, and cassation).

Draft and review factoring agreement;
Review credit agreement, legal action for credit jammed and provide legal opinion for good faith debtors/customer and others banking disputes until court proceeding;
Provide legal opinion to Bank regarding guarantee of credit granted to the debtors/customer;
Handle and finish execution process of guarantee rights or mortgage until auction process.
Labour/Employment Law
Legal action and legal review of work/employment agreement;
Legal drafting and legal review company’s regulation and collective labour agreement;
Strive fulfillment of labour rights with work termination also assist and dispute settlement of industrial relation;

Administrative Law
